Obviously fees can vary according to the complexity of the particular case, however we have set minimum flat fees for the simple routine Chapter 7 and 13 cases.

Fees And Costs In Chapter 7 Proceedings

Most simple Chapter 7 cases are flat rated, with a minimum fee for non - business cases of $1,850.00, and for simple business cases, $2,200.00. In some cases the fees can be substantially higher, however the majority of cases are charged at the minimum rate. The specific fee will be arrived at during the initial conference. The court charges a $299.00 filing fee.

Fees And Costs In Chapter 13 Proceedings

Because the Court has determined that a reasonable fee for Chapter 13 cases filed in Riverside and San Bernardino Counties is $4,000. for non business cases, and $4,500. for small business cases, almost all cases are charged at that rate.  In addition, the court will charge a $274.00 filing fee. For most chapter 13 cases we are willing to accept one half of the attorneys fees, plus the court filing fee to prepare and file the case, with the other half of attorneys fees to be paid through the monthly plan payments along with your other creditors.

Fees And Costs In Chapter 11 And 12 Proceedings

Chapter 11 and Chapter 12 cases are so varied, and range from relatively straightforward and simple cases, to extremely complicated, so there is no way we can set a minimum fee, or flat rate the services. All Chapter 11 cases are charged our current hourly rate, with a minimum advance retainer, all of which is subject to the courts approval. Additionally, the attorney you retain must be specifically approved by the judge assigned to your case. Because of the intensive attorney time required in these cases, the minimum advance retainer for any case will be at least $15,000.00. The court will charge a filing fee of $1,039.00.

Fees And Costs In Tax Problem Cases

We are willing to handle installment agreements and offers in compromise on a flat fee basis, or an hourly fee basis with an advance retainer. The choice is yours, and the specific amounts will be determined at the initial conference. Tax audits, and most other tax problems are handled only on an hourly basis, with an advance retainer when we are hired.

Individuals and Small Proprietorship Businesses:

If you are fairly sure you will need to file a bankruptcy, download the Individual and Sole Proprietorship Questionnaire (pdf) which provides us the information required by the court for filing, which we will use as a worksheet during our conference. Complete and fax it to us, or bring it with you to the conference.

Corporations, Partnerships or Larger Individual Businesses:

  1. Email us. Be sure to include a short description of your particular problem in the comments section; OR
  2. If you are fairly sure you will need to file a bankruptcy, download the Corporate-Partnership Questionnaire (pdf) which provides us the information required by the court for filing, which we will use as a worksheet during our conference. Complete and fax it to us, or bring it with you to the conference.
