Out-of-court debt workouts entail analyzing your particular circumstances, to determine what we could force your creditor(s) to take under the various and appropriate chapters of the Bankruptcy Code.

We then offer the creditor(s) something more than they could reasonably expect in a bankruptcy, and it then becomes a negotiating process to convince the creditor(s) that unless we can arrive at some mutually agreeable terms, you will file a case. Some creditors are quite reasonable, and will work out realistic terms. There are some whose company policy is to play hardball, hoping your other creditors will cut deals to keep you out of a bankruptcy, but by holding out, they will get paid in full, or close to it. If you have many of these creditors, an out of court workout becomes either unlikely, or too expensive, in light of the bankruptcy alternatives.
