Litigation pending at the time of filing a bankruptcy case, or to be brought after a Chapter 11 is filed, can be left in the state court, or depending on what is most beneficial to the client, can usually be removed for trial in the bankruptcy court. If the client is already represented by state court counsel in pending litigation, or has other counsel he prefers to use in filing a state court proceeding, we can usually obtain authorization from the Bankruptcy Court for the state court lawyer to continue representation in the pending litigation as special counsel, whether it is tried in the state court, or the bankruptcy court, while this office handles the bankruptcy issues.
